These Terms of Service ("Terms") are a binding agreement between you and MilkywayInfinity Studio, operated by PRASHBI GLOBAL SERVICES PRIVATE LIMITED (CIN U52100KA2020PTC133490) ("we", "us", "our"), the provider of the Evalu IQ application and related services (together, the "Service"). Please read them carefully. By ticking the acceptance box, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
You accept these Terms by ticking the consent box during setup, or by downloading, installing, accessing or using the Service in any way. Your continued use of the Service after any update to these Terms constitutes acceptance of the updated Terms. If you are accepting on behalf of a child, you represent that you are that child's parent or legal guardian and that you accept these Terms on the child's behalf. Nothing in these Terms limits any rights you have under applicable consumer-protection law that cannot be limited by agreement.
The Service is designed for all ages. If you are under 18 (or the age of majority where you live), you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Profiles created for children under 13 (or under the applicable age of digital consent in your jurisdiction) run in a child-safe mode: we do not ask for or store the child's name or any other personal information, we do not send the child push notifications, and we never serve personalised advertising to the child (see the Privacy Policy for detail). Purchases, including subscriptions, may only be made by an adult account holder through the relevant app store.
Evalu IQ is a collection of puzzle and reasoning games with optional features such as a daily workout, difficulty progression, practice leaderboards, streaks, badges and a composite practice score we call the "RQ score". The Service, including any game, feature, score, level of difficulty, virtual reward or content, may be added to, changed, suspended or withdrawn at any time. Features may be enabled or disabled remotely, including for safety, legal or operational reasons, and availability may differ by region, platform or app version.
You can play as a guest without creating an account; in that case your progress is stored on your device and may be lost if you delete the app, clear its data or change devices, and we are not able to restore it. If and when online accounts become available, you agree to provide accurate information, to keep your credentials confidential and to notify us promptly of any unauthorised use. You are responsible for all activity that occurs under your account or on your device.
Parts of the Service may require a paid subscription ("Evalu IQ Plus" or however named). All purchases are made through, billed by and processed by the app store from which you downloaded the app (Google Play or the Apple App Store) under that store's own terms; we do not collect or store your card details. Unless stated otherwise at the point of purchase: (a) subscriptions renew automatically at the end of each billing period at the then-current price until cancelled; (b) a free trial, where offered, converts automatically into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends; (c) the price, trial length and available plans may vary by country and may change for future billing periods - where required by law we will notify you of a price change in advance and you may cancel before it takes effect; and (d) one active trial and introductory price is offered per person; we may decline repeat trials. Taxes may apply depending on your location.
You can cancel a subscription at any time in your app store's subscription settings (Google Play → Payments & subscriptions; App Store → Apple ID → Subscriptions); deleting the app does NOT cancel a subscription. Cancellation stops future renewals - access to paid features continues until the end of the period already paid for, and periods already begun are generally not refunded pro rata. Refunds are handled by the app store under its refund policy; we cannot issue refunds for purchases billed by a store. Nothing in this section limits any non-waivable statutory refund or withdrawal rights you hold under the law of your country.
The free tier of the Service may show advertising supplied by third-party networks. Ads are never shown inside active puzzle play, and child profiles never receive personalised advertising - child profiles receive at most contextual, family-suitable ads, in line with the Google Play Families policy and applicable children's privacy law. A paid subscription removes advertising where that is stated as a subscription benefit. We are not responsible for the content of third-party advertisements or for the products and services they promote.
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the app on devices you own or control, for your personal, non-commercial entertainment, subject to these Terms. Except as permitted by law that cannot be excluded, you must not: copy, modify, translate, adapt or create derivative works of the Service; distribute, sell, rent, lease, sublicense or otherwise transfer the Service; reverse engineer, decompile or disassemble the Service or attempt to extract its source code, puzzle generators or datasets; remove or obscure any proprietary notices; or use the Service to build a competing product.
You agree not to: (a) cheat, use bots, scripts, automation, exploits or unauthorised third-party software to play or to manipulate scores, streaks, ranks or leaderboards; (b) interfere with or disrupt the Service, its servers or other players; (c) probe, scan or test the vulnerability of the Service or circumvent any security or access control; (d) use the Service for any unlawful purpose or in violation of any applicable law; (e) misrepresent your age during setup; or (f) harvest or collect information about other users. Scores and ranks obtained in breach of this section may be removed, and we may suspend or terminate access as described in section 13.
The Service - including its software, puzzle generators, game rules as expressed in the app, artwork, design, animations, sounds, wordmarks, the "Evalu IQ" name and logo, and all other content - is owned by us or our licensors and is protected by copyright, trade-mark and other intellectual-property laws of India and other countries. These Terms give you no right, title or interest in the Service other than the limited licence in section 8. All rights not expressly granted are reserved. Feedback and suggestions you send us may be used without restriction or compensation.
Evalu IQ is an entertainment product. The RQ score, skill ratings, difficulty bands, progress statistics and any similar figures are practice metrics generated from your play within the app. They are NOT an IQ test, psychometric instrument, medical device, or diagnostic, screening or therapeutic tool; they have not been clinically validated; and they must not be used to diagnose, treat, monitor or make decisions about any medical, psychological, educational or employment matter. We make no claim that using the Service improves intelligence, memory, attention or any other cognitive ability in everyday life. Always seek the advice of a qualified professional for any health or cognitive concern.
The Service is built on third-party platforms and services - including app stores, Google Firebase (authentication, data, messaging, crash reporting), RevenueCat (subscription management), Google AdMob (advertising) and Amplitude (analytics) - each of which processes data under its own terms and privacy policy, as described in our Privacy Policy. We are not responsible for third-party services, their availability or their acts and omissions, except where the law provides otherwise.
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to all or part of the Service, with reasonable notice where practicable, if you materially or repeatedly breach these Terms, if required by law, or if providing the Service (or a part of it) becomes impracticable. Where termination is for your breach, no refund is due for unused subscription time except where the law requires otherwise. Sections that by their nature should survive termination (including 10, 11, 14, 15, 16 and 18) survive.
To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted or error-free operation. We do not warrant that the Service will be available at any particular time, that defects will be corrected, or that any score or statistic is accurate. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the maximum extent permitted by applicable law: (a) we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or expected savings, arising out of or relating to the Service or these Terms, even if advised of the possibility; and (b) our total aggregate liability arising out of or relating to the Service or these Terms is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, INR 1,000). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses and reasonable costs (including legal fees) arising from your breach of these Terms or your unlawful use of the Service. This section does not apply where prohibited by the consumer law of your place of residence.
We may update these Terms from time to time - for example to reflect new features, legal requirements or operational changes. When we make a material change we will bump the version and effective date shown at the top of this document and give you notice within the app (including, where appropriate, asking you to accept the updated Terms again). Changes are not retroactive. If you do not agree to updated Terms, stop using the Service and, if applicable, cancel your subscription before the next renewal.
These Terms are governed by the laws of India, without regard to conflict-of-law rules, and subject to any mandatory consumer law of your country of residence. Subject to that mandatory law, the courts at Bengaluru, Karnataka, India have exclusive jurisdiction over disputes arising out of or relating to the Service or these Terms. If you are a consumer, you retain any right you have to bring proceedings before your local courts or consumer forums (in India, under the Consumer Protection Act, 2019). Before starting formal proceedings, please contact us - most concerns can be resolved quickly and informally.
These Terms, together with the Privacy Policy, are the entire agreement between you and us concerning the Service. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in full force. Our failure to enforce a provision is not a waiver of it. You may not assign or transfer these Terms; we may assign them in connection with a merger, acquisition or sale of assets, subject to applicable law. We are not liable for delay or failure caused by events beyond our reasonable control. The English version of these Terms controls to the extent a translation conflicts with it, except where the law of your country requires otherwise.

यह सेवा सभी आयु वर्गों के लिए बनाई गई है। यदि आप 18 वर्ष से कम (या अपने देश में वयस्कता की आयु से कम) हैं, तो आप सेवा का उपयोग केवल माता-पिता या कानूनी अभिभावक की सहमति और निगरानी में कर सकते हैं, जो आपकी ओर से इन शर्तों से सहमत हों। 13 वर्ष से कम (या आपके न्यायक्षेत्र में लागू डिजिटल सहमति आयु से कम) उम्र के बच्चों की प्रोफ़ाइल बाल-सुरक्षित मोड में चलती है: हम बच्चे का नाम या कोई अन्य व्यक्तिगत जानकारी नहीं माँगते और न सहेजते हैं, बच्चे को पुश सूचनाएँ नहीं भेजते, और बच्चे को कभी वैयक्तिकृत विज्ञापन नहीं दिखाते (विवरण गोपनीयता नीति में)। सदस्यता सहित सभी खरीदारी केवल वयस्क खाताधारक द्वारा संबंधित ऐप स्टोर के माध्यम से की जा सकती है।
Evalu IQ पहेली और तर्क खेलों का संग्रह है, जिसमें दैनिक वर्कआउट, कठिनाई प्रगति, अभ्यास लीडरबोर्ड, स्ट्रीक, बैज और "RQ स्कोर" नामक एक समग्र अभ्यास स्कोर जैसी वैकल्पिक सुविधाएँ शामिल हैं। सेवा - किसी भी खेल, सुविधा, स्कोर, कठिनाई स्तर, आभासी पुरस्कार या सामग्री सहित - को किसी भी समय जोड़ा, बदला, निलंबित या हटाया जा सकता है। सुविधाएँ सुरक्षा, कानूनी या परिचालन कारणों से दूरस्थ रूप से चालू या बंद की जा सकती हैं, और उपलब्धता क्षेत्र, प्लेटफ़ॉर्म या ऐप संस्करण के अनुसार भिन्न हो सकती है।
आप बिना खाता बनाए अतिथि के रूप में खेल सकते हैं; इस स्थिति में आपकी प्रगति आपके डिवाइस पर सहेजी जाती है और ऐप हटाने, डेटा साफ़ करने या डिवाइस बदलने पर खो सकती है - हम उसे पुनर्स्थापित नहीं कर सकते। जब ऑनलाइन खाते उपलब्ध हों, तो आप सटीक जानकारी देने, अपने क्रेडेंशियल गोपनीय रखने और किसी भी अनधिकृत उपयोग की तुरंत सूचना देने के लिए सहमत होते हैं। आपके खाते या डिवाइस पर होने वाली सभी गतिविधियों की ज़िम्मेदारी आपकी है।
सेवा के कुछ हिस्सों के लिए सशुल्क सदस्यता आवश्यक हो सकती है। सभी खरीदारी उस ऐप स्टोर (Google Play या Apple App Store) के माध्यम से, उसकी अपनी शर्तों के तहत बिल और प्रोसेस की जाती है, जहाँ से आपने ऐप डाउनलोड किया; हम आपके कार्ड का विवरण एकत्र या संग्रहीत नहीं करते। जब तक खरीद के समय अन्यथा न कहा जाए: (क) सदस्यता प्रत्येक बिलिंग अवधि के अंत में तत्कालीन मूल्य पर स्वतः नवीनीकृत होती है, जब तक आप रद्द न करें; (ख) नि:शुल्क ट्रायल, जहाँ उपलब्ध हो, ट्रायल समाप्त होने से कम से कम 24 घंटे पहले रद्द न करने पर स्वतः सशुल्क सदस्यता में बदल जाता है; (ग) मूल्य, ट्रायल अवधि और उपलब्ध प्लान देश के अनुसार भिन्न हो सकते हैं और भविष्य की बिलिंग अवधियों के लिए बदल सकते हैं - जहाँ कानून अपेक्षित करे, हम मूल्य परिवर्तन की पूर्व सूचना देंगे और आप उसके प्रभावी होने से पहले रद्द कर सकते हैं; और (घ) प्रति व्यक्ति एक सक्रिय ट्रायल और प्रारंभिक मूल्य दिया जाता है; हम बार-बार के ट्रायल अस्वीकार कर सकते हैं। आपके स्थान के अनुसार कर लागू हो सकते हैं।
आप अपने ऐप स्टोर की सदस्यता सेटिंग में किसी भी समय सदस्यता रद्द कर सकते हैं (Google Play → भुगतान और सदस्यताएँ; App Store → Apple ID → Subscriptions); ऐप हटाने से सदस्यता रद्द नहीं होती। रद्दीकरण भविष्य के नवीनीकरण रोकता है - भुगतान की गई अवधि के अंत तक सशुल्क सुविधाएँ चालू रहती हैं, और शुरू हो चुकी अवधि की आम तौर पर आनुपातिक धनवापसी नहीं होती। धनवापसी ऐप स्टोर की धनवापसी नीति के तहत होती है; स्टोर द्वारा बिल की गई खरीद की धनवापसी हम नहीं कर सकते। यह अनुभाग आपके देश के कानून के तहत मिले अपरिहार्य वैधानिक अधिकारों को सीमित नहीं करता।
सेवा के नि:शुल्क स्तर पर तृतीय-पक्ष नेटवर्क के विज्ञापन दिखाए जा सकते हैं। सक्रिय पहेली खेल के भीतर कभी विज्ञापन नहीं दिखाए जाते, और बाल प्रोफ़ाइल को कभी वैयक्तिकृत विज्ञापन नहीं मिलते - बाल प्रोफ़ाइल को अधिकतम प्रासंगिक, परिवार-उपयुक्त विज्ञापन ही दिखते हैं, Google Play Families नीति और लागू बाल-गोपनीयता कानूनों के अनुरूप। जहाँ सदस्यता-लाभ के रूप में कहा गया हो, सशुल्क सदस्यता विज्ञापन हटा देती है। तृतीय-पक्ष विज्ञापनों की सामग्री या उनमें प्रचारित उत्पादों-सेवाओं के लिए हम उत्तरदायी नहीं हैं।
हम आपको अपने स्वामित्व या नियंत्रण वाले डिवाइस पर, व्यक्तिगत और गैर-व्यावसायिक मनोरंजन के लिए, इन शर्तों के अधीन ऐप इंस्टॉल और उपयोग करने का व्यक्तिगत, सीमित, गैर-अनन्य, अहस्तांतरणीय, उप-लाइसेंस-रहित और प्रतिसंहरणीय लाइसेंस देते हैं। कानून द्वारा अनुमत सीमा को छोड़कर, आप: सेवा की प्रतिलिपि, संशोधन, अनुवाद या व्युत्पन्न कृतियाँ नहीं बनाएँगे; सेवा का वितरण, विक्रय, किराया या हस्तांतरण नहीं करेंगे; सेवा की रिवर्स इंजीनियरिंग, डीकंपाइल या डिससेम्बल नहीं करेंगे और न ही उसके सोर्स कोड, पहेली जनरेटर या डेटासेट निकालने का प्रयास करेंगे; स्वामित्व सूचनाएँ नहीं हटाएँगे; या प्रतिस्पर्धी उत्पाद बनाने के लिए सेवा का उपयोग नहीं करेंगे।
आप सहमत हैं कि आप: (क) धोखाधड़ी, बॉट, स्क्रिप्ट, ऑटोमेशन, एक्सप्लॉइट या अनधिकृत तृतीय-पक्ष सॉफ़्टवेयर से खेलेंगे या स्कोर, स्ट्रीक, रैंक या लीडरबोर्ड में हेरफेर नहीं करेंगे; (ख) सेवा, उसके सर्वर या अन्य खिलाड़ियों में बाधा नहीं डालेंगे; (ग) सेवा की सुरक्षा की जाँच, स्कैन या उसे दरकिनार नहीं करेंगे; (घ) सेवा का उपयोग किसी गैरकानूनी उद्देश्य से नहीं करेंगे; (ङ) सेटअप के दौरान अपनी आयु गलत नहीं बताएँगे; या (च) अन्य उपयोगकर्ताओं की जानकारी एकत्र नहीं करेंगे। इस अनुभाग के उल्लंघन से प्राप्त स्कोर और रैंक हटाए जा सकते हैं, और हम अनुभाग 13 के अनुसार पहुँच निलंबित या समाप्त कर सकते हैं।
सेवा - उसका सॉफ़्टवेयर, पहेली जनरेटर, ऐप में व्यक्त खेल नियम, कलाकृति, डिज़ाइन, एनिमेशन, ध्वनियाँ, "Evalu IQ" नाम और लोगो, तथा अन्य सारी सामग्री - हमारी या हमारे लाइसेंसदाताओं की संपत्ति है और भारत तथा अन्य देशों के कॉपीराइट, ट्रेडमार्क और अन्य बौद्धिक-संपदा कानूनों से संरक्षित है। ये शर्तें आपको अनुभाग 8 के सीमित लाइसेंस के अलावा सेवा में कोई अधिकार, स्वत्व या हित नहीं देतीं। स्पष्ट रूप से न दिए गए सभी अधिकार सुरक्षित हैं। आपके भेजे सुझावों का उपयोग बिना किसी प्रतिबंध या मुआवज़े के किया जा सकता है।
Evalu IQ एक मनोरंजन उत्पाद है। RQ स्कोर, कौशल रेटिंग, कठिनाई बैंड, प्रगति आँकड़े और ऐसी अन्य संख्याएँ ऐप के भीतर आपके खेल से बने अभ्यास मीट्रिक हैं। ये IQ परीक्षण, मनोमितीय उपकरण, चिकित्सा उपकरण, या निदान, स्क्रीनिंग अथवा उपचार का साधन नहीं हैं; इनका नैदानिक सत्यापन नहीं हुआ है; और इनका उपयोग किसी चिकित्सीय, मनोवैज्ञानिक, शैक्षिक या रोज़गार संबंधी निर्णय के लिए नहीं किया जाना चाहिए। हम यह दावा नहीं करते कि सेवा का उपयोग रोज़मर्रा के जीवन में बुद्धिमत्ता, स्मृति, ध्यान या किसी अन्य संज्ञानात्मक क्षमता को बेहतर बनाता है। किसी भी स्वास्थ्य या संज्ञानात्मक चिंता के लिए हमेशा योग्य पेशेवर की सलाह लें।
सेवा तृतीय-पक्ष प्लेटफ़ॉर्मों और सेवाओं पर आधारित है - जिनमें ऐप स्टोर, Google Firebase (प्रमाणीकरण, डेटा, संदेश, क्रैश रिपोर्टिंग), RevenueCat (सदस्यता प्रबंधन), Google AdMob (विज्ञापन) और Amplitude (विश्लेषण) शामिल हैं - जिनमें से प्रत्येक अपनी शर्तों और गोपनीयता नीति के तहत डेटा प्रोसेस करता है, जैसा हमारी गोपनीयता नीति में बताया गया है। कानून द्वारा अन्यथा प्रावधान को छोड़कर, तृतीय-पक्ष सेवाओं, उनकी उपलब्धता या उनके कृत्यों के लिए हम उत्तरदायी नहीं हैं।

लागू कानून द्वारा अनुमत अधिकतम सीमा तक: (क) हम अप्रत्यक्ष, आनुषंगिक, विशेष, परिणामी, अनुकरणीय या दंडात्मक क्षति, अथवा लाभ, राजस्व, डेटा, साख या अपेक्षित बचत की हानि के लिए उत्तरदायी नहीं हैं, भले ही ऐसी संभावना की सूचना दी गई हो; और (ख) सेवा या इन शर्तों से उत्पन्न हमारा कुल संचयी दायित्व, दावे को जन्म देने वाली घटना से पूर्व 12 महीनों में आपने सेवा के लिए हमें जो राशि चुकाई उस तक (या, यदि कुछ नहीं चुकाया, तो ₹1,000 तक) सीमित है। इन शर्तों की कोई बात उस दायित्व को बाहर या सीमित नहीं करती जिसे लागू कानून के तहत बाहर या सीमित नहीं किया जा सकता - जिसमें लापरवाही से हुई मृत्यु या व्यक्तिगत चोट, या कपट का दायित्व शामिल है।

ये शर्तें भारत के कानूनों द्वारा शासित हैं, विधि-संघर्ष नियमों की परवाह किए बिना, और आपके निवास देश के अनिवार्य उपभोक्ता कानून के अधीन। उस अनिवार्य कानून के अधीन, सेवा या इन शर्तों से उत्पन्न विवादों पर बेंगलुरु, कर्नाटक, भारत की अदालतों का अनन्य क्षेत्राधिकार होगा। यदि आप उपभोक्ता हैं, तो अपने स्थानीय न्यायालयों या उपभोक्ता मंचों (भारत में उपभोक्ता संरक्षण अधिनियम, 2019 के तहत) में कार्यवाही का आपका अधिकार बना रहता है। औपचारिक कार्यवाही से पहले कृपया हमसे संपर्क करें - अधिकांश समस्याएँ शीघ्र और अनौपचारिक रूप से सुलझ जाती हैं।
ये शर्तें, गोपनीयता नीति सहित, सेवा के संबंध में आपके और हमारे बीच संपूर्ण समझौता हैं। यदि कोई प्रावधान अमान्य या अप्रवर्तनीय ठहराया जाता है, तो उसे अधिकतम अनुमेय सीमा तक लागू किया जाएगा और शेष प्रावधान पूर्ण रूप से प्रभावी रहेंगे। किसी प्रावधान को लागू न करना उसका परित्याग नहीं है। आप ये शर्तें हस्तांतरित नहीं कर सकते; हम विलय, अधिग्रहण या परिसंपत्ति विक्रय की स्थिति में, लागू कानून के अधीन, इन्हें हस्तांतरित कर सकते हैं। हमारे उचित नियंत्रण से परे घटनाओं से हुई देरी या विफलता के लिए हम उत्तरदायी नहीं हैं। अनुवाद में विरोध की स्थिति में इन शर्तों का अंग्रेज़ी संस्करण मान्य होगा, सिवाय जहाँ आपके देश का कानून अन्यथा अपेक्षित करे।
